These Terms of Use ("Terms") govern your access to and use of the GoLibre mobile application, website, and related services (collectively, the "Platform"), operated by GoLibre, Inc. ("GoLibre," "Company," "we," "us," or "our").
By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.
1. What GoLibre Is (Important)
GoLibre is a peer-to-peer vehicle sharing platform that connects vehicle owners ("Hosts") with renters ("Renters").
GoLibre does not own vehicles and is not a transportation provider.
GoLibre acts solely as a technology platform and intermediary.
2. Eligibility
To use GoLibre, you must:
- Be at least 21 years old (unless otherwise specified)
- Hold a valid driver's license
- Meet all eligibility requirements set by GoLibre and its insurance partners
- Provide accurate, complete, and truthful information
We reserve the right to deny or revoke access at our discretion.
3. Account Registration
You agree to:
- Create only one account
- Keep login credentials secure
- Notify us of unauthorized access
- Accept responsibility for all activity under your account
Providing false information is grounds for immediate suspension or termination.
4. Vehicle Listings (Hosts)
Hosts are solely responsible for:
- Vehicle ownership or legal authorization
- Vehicle condition, safety, and legality
- Accurate listings, photos, and descriptions
- Compliance with local laws and regulations
GoLibre may remove or suspend listings that do not meet platform standards.
5. Bookings & Payments
- Rental prices are set by Hosts
- GoLibre charges a platform service fee
- Payments are processed through third-party payment providers
- Payouts to Hosts occur per GoLibre's payout schedule
GoLibre is not responsible for payment disputes beyond platform processing.
6. Insurance & Protection
Insurance coverage, if offered, is provided through third-party insurers and subject to separate terms.
GoLibre:
- Does not act as an insurer
- Does not guarantee coverage
- Does not determine claim outcomes
Users agree to cooperate fully with any claims process.
7. Accidents, Damage & Incidents
In the event of an accident, damage, theft, or incident:
- Users must report promptly through the Platform
- Users must provide accurate documentation
- Failure to report may result in loss of coverage or account suspension
GoLibre reserves the right to recover costs, deduct fees, or pursue reimbursement.
8. User Conduct (Strict)
You agree NOT to:
- Use the Platform for illegal purposes
- Provide false or misleading information
- Circumvent fees or policies
- Damage vehicles intentionally
- Harass, threaten, or abuse other users
- Allow unauthorized drivers
- Sublease or commercialize bookings without permission
Violations may result in immediate termination.
9. Platform Fees & Changes
GoLibre may:
- Modify service fees
- Update policies
- Change features or availability
Changes will be communicated via the Platform or email.
10. Cancellations & Refunds
Cancellation and refund rules are displayed at booking and vary by:
- Timing
- Host policy
- Circumstances
GoLibre may issue credits or refunds at its discretion.
11. No Guarantees
The Platform is provided "as is" and "as available."
GoLibre does not guarantee:
- Vehicle availability
- Earnings for Hosts
- Rental suitability
- Continuous or error-free operation
12. Limitation of Liability
To the maximum extent permitted by law:
- GoLibre is not liable for indirect, incidental, or consequential damages
- GoLibre's total liability shall not exceed the fees paid to GoLibre for the transaction giving rise to the claim
13. Indemnification
You agree to indemnify and hold harmless GoLibre from claims arising out of:
- Your use of the Platform
- Your vehicle
- Your conduct
- Violations of these Terms or applicable law
14. Suspension & Termination
GoLibre may suspend or terminate accounts at any time for:
- Policy violations
- Risk concerns
- Fraud
- Safety issues
- Legal or compliance reasons
Termination may occur without prior notice.
15. Intellectual Property
All Platform content, trademarks, and software belong to GoLibre or its licensors.
Users may not copy, modify, or distribute Platform materials without permission.
16. Privacy
Your use of the Platform is subject to our Privacy Policy, which governs data collection and use.
17. Dispute Resolution
Disputes shall be resolved through:
- Good-faith negotiation first
- Binding arbitration where permitted
- Governing law as outlined below
18. Governing Law
These Terms are governed by the laws of:
- State of Delaware, USA
- Without regard to conflict-of-laws principles
19. Changes to Terms
We may update these Terms from time to time. Continued use of the Platform constitutes acceptance of updated Terms.
